Shane leads our Litigation & Dispute Resolution and Debt Recovery & Insolvency practice groups.

He has over 15 years' experience spanning general corporate and commercial litigation, insolvency, property and insurance litigation and administrative law across a range of industry sectors. He has specialist expertise in professional disciplinary jurisdictions acting for both regulators and individuals.

Shane has extensive experience advising directors, shareholders and business owners on a range of commercial disputes, and practices in the Federal, Supreme, District and Magistrates Courts and the Queensland Civil and Administrative Tribunal. His commercial approach emphasises outcomes and solutions that best meet the needs of his clients.

Experience

Litigation and Dispute Resolution

  • Farming Client

    Acting for an individual client and farming business in a $16 million claim for breach of contract and negligence relating to loss caused by fire.  Successful at first instance following a four week trial and in the Court of Appeal.  Our client recovered full damages and indemnity costs.
  • McNab Constructions Australia Pty Ltd

    Successfully setting aside a statutory demand in the Supreme Court with costs orders in McNab’s favour.
  • Australia Post

    Overseeing retail shop leasing disputes for Australia Post in the Queensland Civil and Administrative Tribunal.
  • Australian Broadcasting Corporation

    Acting for the ABC in a Supreme Court contractual dispute about the purchase of a $15 million development site, including contractual and trade practices issues surrounding contamination and remediation of land.  We negotiated the outcome prior to trial favourable to the ABC.
  • Austock Funds Limited & Austock Group

    Successfully resisting a multi-million dollar claim for breach of contract and misleading and deceptive conduct in the sale of child care centres, with costs in the client’s favour in the Supreme Court of Victoria.
  • Minority shareholder

    Acting for a minority shareholder in a small publicly listed entity in obtaining orders under the Corporations Act for the mandatory buy-out of the minority shareholding by the majority shareholder.
  • Major construction company

    Acting for a major Queensland construction company in respect of a staff fraud of $3.4 million and obtaining immediate freezing orders resulting in recovery of a significant portion of the funds.
  • Storage and logistics company

    Acting for a logistics company in a dispute about an equipment supply agreement.
  • Mine supply chain participant

    Successfully defending a $5.2 million contractual and negligence claim for a logistics company relating to the sale of rail head and storage facility in regional NSW.
  • International travel company

    Acting for a minority international shareholder in an Australian listed entity and its subsidiary involving division of shareholding and demerger of numerous international companies and assets, including disputed intellectual property assets.
  • Mining company

    Acting for a mining services provider in a contractual dispute with a supplier of long wall mining equipment.
  • Board of Professional Engineers of Queensland

    Advising on disciplinary and review proceedings in the Queensland Civil and Administrative Tribunal and regulatory prosecutions.

    Advising on bulk debt recovery and enforcement matters.
  • New Zealand Government – Inland Revenue Department

    Advising on registering and enforcing numerous New Zealand student loan and child support judgment debts in Australia.).
  • Workpac

    Overseeing bulk debt recovery and enforcement matters, including guarantee and security enforcement
  • ReMax Group

    Advising on the recovery and enforcement of franchise debts across all Australian states (recovery rate ex liquidation – 94 percent).
  • Glenzeil

    Acting for the Liquidators of Glenzeil Constructions in various claims under the Subcontractors’ Charges Act.
  • Liquidators of Norman Nominees Pty Ltd

    Acting for the liquidator of Norman Nominees Pty Ltd in a Supreme Court claim involving breaches of director’s duties and uncommercial transactions.  After a three week trial, judgment was awarded in the liquidator’s favour for approximately $6 million, including indemnity costs.
  • Queensland Government Departments

    Consulting to various Queensland Government Departments to develop and roll-out statutory debt recovery processes and precedents for recovery of various forms of statutory debt, including tenement and licence fees, annual returns, levies, fines, and director contributions.
  • Recovery and insolvency management issues

    Acting for various liquidators, receivers and administrators in relation to recovery and insolvency management issues.
