Dealing with the Three Amigos: Adverse Action, Unfair Dismissal and Bullying

When it comes to managing employee claims, prevention is better than the cure. By analysing recent trends in case law regarding unfair dismissal, general protections and stop-bullying applications, employers can take steps to minimise their potential exposure.

During this seminar, Murray will look back on the more significant decisions of the Fair Work Commission and the Courts from 2017, to identify trends and outline strategies for employers to more effectively handle disciplinary and performance management processes.

  • How the Fair Work Commission has dealt with procedural fairness issues where there is a valid reason for dismissal;
  • The importance of a manager’s evidence when responding to an adverse action claim;
  • The rising cost of damages for successful general protections applications;
  • The scope for a manager’s personal liability; and
  • The “reasonable management action” exemption to stop-bullying claims.
